In this procurement process, the engineering services and the construction services are both provided directly to the Owner through independent contracts. For public projects in Texas, the engineer is selected through a Qualifications Based Selection process with fee negotiation after the engineering consultant is selected. The Engineer then produces the plans and bid package, which is competitively bid by the construction industry in a publicly advertised process. This procurement process places the Owner in a control position for both the design and construction phases of the project. During construction, the Engineer is in a position to work for the Owner in a construction support role to observe the Contractor's level of adherence to the design plans and specifications. Disputes between the Contractor and the Engineer are reconciled by the Owner, who has the direct vested interest in the project outcome. Public projects in Texas are procured in this manner by legislation. Privately procured projects can also utilize this method. Copyright
